These Terms of Service (“Terms”) govern the use of the Software and Services provided by:

(“Festivo”, “Company”, “we”)
The Software and Services are intended solely for use by businesses, developers, and other professional entities acting in the course of their trade or profession. The Services are not intended for consumers.
Festivo provides a web-based API and related software services, including access to holiday and observance data. Services are provided online and may be modified, improved, or discontinued at Festivo’s discretion.
You are responsible for maintaining the confidentiality of your account credentials and for all activities performed under your account.
Subject to payment of applicable fees, you are granted a non-exclusive, non-transferable license to use the Software and Services for your internal business purposes for the duration of the agreement.
You agree to use the Services in compliance with applicable laws and not to misuse the Services, including attempting unauthorized access, distributing malicious code, or infringing third-party rights.
Data obtained via the Services may be cached or stored temporarily subject to plan limitations. Free plans may persist data for up to two (2) hours; paid plans for up to twenty-four (24) hours or until subscription expiry.
Fees are charged on a subscription basis and payable in advance. Subscriptions renew automatically unless cancelled prior to the renewal date.
Except where mandatory consumer protection laws apply, all Fees are non-refundable once access to the Services has been granted.
If you are a consumer within the meaning of applicable consumer protection laws, you generally have the right to withdraw from this agreement within fourteen (14) days without giving any reason.
However, due to the nature of the Services as digital services provided immediately upon purchase, this right of withdrawal does not apply once the performance of the Services has begun, provided that:
By providing such consent and acknowledgment, you agree that no refund will be due once access to the Services has been granted.
You are responsible for all applicable taxes. Where transactions are subject to Polish tax regulations, invoices may be issued and registered in the Polish National System of e-Invoices (Krajowy System e-Faktur – “KSeF”).
In such cases, the legally binding invoice is the structured electronic invoice registered in KSeF. Any PDF or other visual representation constitutes a visualization provided for informational purposes only.
Where technically available, a verification code (e.g. QR code) may be included. Where such data is not available due to technical limitations, invoices may be provided without a verification code and with an appropriate informational annotation.
Polish electronic invoicing regulations apply only to transactions subject to Polish VAT law. Festivo is not responsible for compliance with tax or invoicing regulations outside Poland.
All rights, title, and interest in the Software and Services remain with Festivo. You retain ownership of your own data.
Each party shall keep confidential any non-public information obtained in connection with the Services, except where disclosure is required by law.
Personal data is processed in accordance with the Privacy Policy and Data Processing Agreement.
Either party may terminate the agreement at any time by providing written notice. Upon termination, access to the Services will cease.
The Software and Services are provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law.
To the maximum extent permitted by law, Festivo’s total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
These Terms are governed by the laws of the Republic of Poland and applicable European Union law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.
Festivo may modify these Terms with prior notice. Continued use of the Services constitutes acceptance of the updated Terms.
